Position Summary:
Responsible for conducting, coordinating and/or assisting with: (i) the
review and structure of marketing and advertising initiatives, including
digital media and direct marketing executions; (ii) the review and
administration of contests and sweepstakes, mobile and email
communications, and coupons and other promotions; (iii) compliance with
global privacy and data security laws and (iv) contract drafting, review
and administration for various marketing initiatives. The position will
also be responsible for assisting in other matters as needed. The
position reports to the Managing Counsel for Global Regulatory Matters.
Key Responsibilities May Include:
Advertising and Marketing Review
- Review brand marketing communications and advertising to
ensure claims are substantiated, intellectual property is properly used
and FTC and other regulatory requirements are met.
- Work with corporate counsel to advise cross-functional
business partners on policies, procedures and legal issues related to
the foregoing areas.
- Additional duties and responsibilities as needed.
Direct Marketing and Promotions
- Draft and review rules for, and assist with administration of,
various contests and sweepstakes on traditional and digital platforms.
- Advise on and review mobile and email communications and
promotions to ensure compliance with applicable laws.
- Advise on and review coupons, rebates and other
consumer/shopper promotional activities.
- Provide cross-functional coordination on integrated marketing
campaigns and promotions.
Privacy and Data Security
- Review promotional and marketing activities and administer
corporate procedures to ensure compliance with state, federal and
international laws regarding consumer privacy.
- Assist with efforts to ensure sensitive consumer and employee
data is secure.
- Provide project management support to Information Services,
Human Resources, Marketing and other business units in development of
information security measures.
- Track, monitor and assess new privacy and network security
laws and regulations and industry best practices.
Contracts
- Review, and at times negotiate, contracts with third parties,
including sponsorship, joint-marketing, services, agency, spokesperson,
cause marketing, technology and intellectual property agreements.
- Assist with administration of contracting process to ensure
deadlines are met and proper approvals and documentation are obtained.
- Coordinate privacy-related commercial terms and proper consent
flows with vendors, partnerships, and other contractual arrangements.
Required Qualifications:
- Bachelor's degree or equivalent experience.
- 5+ years of legal experience involving with one or more of the
following areas: advertising review; intellectual property, particularly
copyrights and trademarks; marketing through digital media, social
media, mobile executions and integrated marketing campaigns; e-commerce
and the Internet; FTC and/or FDA claims substantiation experience;
contract review; global privacy and data security; direct marketing
activities; contests and sweepstakes; and/or branded entertainment.
- Law Firm or in-house paralegal experience.
- Strong verbal and written communication skills.
- Excellent planning & organizational skills, time management, &
analytical skills.
- Team Player - ability to work with others directly and indirectly.
Ability to interrelate politely, professionally but firmly with
demanding clients, influence when needed.
- Ability to take a significant level of direct responsibility for
general legal matters, with oversight from attorneys.
- Ability to identify, prioritize and resolve critical issues in real
time.
- Unquestioned personal integrity; seen as a role model for ethical
principles and values of the Company and practices required by law.
- Excellent judgment, interpersonal and communication skills.
- Strong ability to guide, influence and instill confidence in

- Ability to handle sensitive and confidential information.
- Urgency and results focus to ensure timely and appropriate response to
issues raised.
- Strong skills in leadership - the ability to drive and lead while
working with legal and technical staffs.
- Strong decision-making and problem-solving skills.
- Strong PC skills (Microsoft Office) and any other programs.
Desired Qualifications:
- Advanced degree or training preferred.
- IAPP certification a plus.
- Familiarity with cutting-edge technology, social media, website and
data systems infrastructure, licensing, and media and entertainment
issues a plus
